By requesting, booking, paying for, accepting delivery of, or using totes or other services provided by Shenandoah Stuff Gone (“Company,” “we,” “us,” or “our”), the person booking the service (“Customer,” “you,” or “your”) acknowledges and agrees to the following terms.
Shenandoah Stuff Gone provides a residential decluttering tote service. Customers select a tote package, we deliver the designated number of reusable totes to the agreed exterior location, the Customer normally has seven (7) calendar days to fill the totes with permitted unwanted household items, and we return to collect the totes and their contents. Depending on the nature and condition of collected items, items may be donated, recycled, transferred to an appropriate facility, or otherwise responsibly disposed of at the Company's discretion and subject to applicable laws and facility requirements.
Shenandoah Stuff Gone is not a moving company, storage company, professional organizer, hazardous-waste service, appraiser, or custodian of valuable property unless expressly agreed otherwise in writing.
The Customer represents that they are at least 18 years old and legally authorized to request service at the provided property. Standard service is intended for clearly visible and reasonably accessible outdoor areas. Shenandoah Stuff Gone does not enter the interior living areas of residences as part of standard tote delivery or pickup.
If the Customer selects Garage or Backyard / Gated Area, the Customer must provide the separate access authorization displayed in the booking form. That authorization permits Shenandoah Stuff Gone to enter only the specifically selected non-living-area location, and only as reasonably necessary to deliver and/or retrieve the totes. An open garage door, open gate, unlocked door, or other apparent access does not by itself constitute authorization.
The Customer represents that they own or control the property or otherwise have authority from the property owner, landlord, homeowners association, property manager, or other responsible party to grant the requested access.
The Customer must designate an appropriate delivery location. Preferred placement is a clearly visible, reasonably level, easily accessible outdoor area such as a driveway, front yard, side yard, or front porch. Garage or backyard/gated-area placement requires the Customer's separate affirmative authorization during booking. Shenandoah Stuff Gone may use an alternate safe exterior location or decline the requested placement if the selected area appears unsafe, inaccessible, obstructed, or inconsistent with these Terms.
After delivery, the Customer is responsible for monitoring and maintaining the location of the totes and for moving them if their position becomes unsafe, obstructive, or inconvenient.
The Customer agrees to keep totes away from or relocate them from public sidewalks and roadways, stairs and steps, emergency exits, frequently traveled walkways, vehicle travel areas, fire or utility equipment, drainage areas, and any location where a tote could create an unreasonable obstruction or hazard. The Customer is responsible for informing household members, occupants, guests, contractors, and other persons on the property of the totes' presence.
Nothing in these Terms is intended to waive liability that cannot legally be waived under applicable Virginia law.
Totes are not toys and are not intended for climbing, sitting, standing, riding, hiding, sleeping, or playing. The Customer is responsible for supervising children and animals around the totes. All dogs and other animals must be securely contained inside the residence or in a separate secured area that Shenandoah Stuff Gone will not be entering during delivery and pickup. A fenced yard alone does not qualify if an animal is loose within the area needed for access. Shenandoah Stuff Gone will not enter a yard, garage, or other service area containing a loose animal, regardless of temperament. If an animal prevents safe access, service may be postponed and a return-trip fee may apply. The Customer must maintain reasonably safe access to the totes.
Unless otherwise stated in the confirmed booking, the standard service period is seven (7) calendar days beginning on the delivery date. Totes must be ready and accessible for pickup on the scheduled collection date. Extensions are subject to availability and, when approved, are charged at $10 per tote, per additional day. Customers should request an extension before the scheduled pickup date. Failure to make the totes accessible may result in a failed-pickup or additional-trip fee.
No individual tote may exceed 40 pounds when filled. The Customer is responsible for compliance with this limit. Shenandoah Stuff Gone may refuse to lift, move, or transport any tote that appears overloaded, unsafe, improperly packed, contaminated, or otherwise unsuitable for safe handling. The Customer may be required to remove items before collection. Additional trips or handling caused by an overweight tote may result in additional charges disclosed in the booking terms.
Customers must not place prohibited, dangerous, illegal, hazardous, leaking, contaminated, or otherwise unsuitable materials in a tote. Prohibited items include, without limitation: gasoline or other fuel; propane or compressed-gas containers; paint, solvents, stains, motor oil, chemicals, pesticides, herbicides, or poisons; explosives or fireworks; firearms or ammunition; medical or biohazardous waste; needles, syringes, or sharps; human or animal waste; uncontained broken glass or dangerous sharp objects; wet, leaking, or unidentified liquids; batteries when prohibited by the receiving facility; illegal drugs or contraband; asbestos or suspected asbestos-containing material; radioactive materials; spoiled, rotting, opened, refrigerated, frozen, or expired food; live animals or animal remains; large furniture or mattresses unless separately approved; yard waste; construction debris; and anything reasonably considered dangerous or unlawful to transport or handle.
Electronics, appliances, batteries, and other specially regulated materials may require advance approval or separate arrangements. Shenandoah Stuff Gone reserves the right to refuse any item at pickup.
The standard tote service is intended primarily for decluttering and removal of reusable, donatable, recyclable, or otherwise acceptable household items. Ordinary household trash and small broken household items must use the approved 42-gallon contractor-bag add-on when offered. Hazardous or prohibited materials cannot be made acceptable merely by placing them inside a contractor bag.
The Customer represents and warrants that every item placed in a tote belongs to the Customer or that the Customer has legal authority from the owner to relinquish the item. The Customer must not place property belonging to a spouse, partner, roommate, tenant, landlord, family member, employer, or any other third party in a tote without authorization. The Customer is responsible for disputes arising from property they were not legally authorized to relinquish.
The Customer is responsible for carefully checking every tote before collection. Customers should never intentionally place cash, jewelry, credit or debit cards, passports, driver's licenses, Social Security cards, birth certificates, titles, deeds, keys, prescription medication, financial records, family photographs, sentimental items, valuable antiques or collectibles, or any item the Customer may later want returned into the totes.
By making a filled tote available for collection, the Customer confirms that the contents are intentionally being relinquished and authorizes Shenandoah Stuff Gone to remove them. Once an item has been collected and transferred, donated, recycled, disposed of, or otherwise processed, recovery may be impossible. Shenandoah Stuff Gone does not guarantee that an accidentally relinquished item can be located or returned.
Shenandoah Stuff Gone will make reasonable decisions regarding whether collected property is suitable for donation, recycling, transfer, or disposal. The Customer does not control the ultimate recipient or destination of an item unless specifically agreed in writing. Acceptance standards are determined by receiving organizations and facilities and may change. The Company does not guarantee that every item will be accepted for donation or that the Customer will receive a charitable donation receipt or tax deduction.
The Customer understands that totes may remain outside during the service period. The Customer is responsible for monitoring weather conditions, keeping lids completely closed, and taking reasonable steps to protect tote contents when necessary. The Company does not represent that totes are watertight, waterproof, animal-proof, or capable of protecting sensitive property from all weather conditions.
Shenandoah Stuff Gone may delay or reschedule delivery or pickup when snow, ice, flooding, severe storms, road closures, unsafe driveways, unsafe access conditions, or other weather-related conditions make service unsafe or impractical. A weather-related safety reschedule will not, by itself, be treated as a failure by the Company to provide service.
Totes remain the property of Shenandoah Stuff Gone. Customers agree not to intentionally damage, permanently alter, paint, drill, cut, burn, dismantle, or misuse the totes. The Customer should promptly report a tote that is lost, stolen, or materially damaged. A $25 replacement fee per tote may apply for totes that are lost, stolen, missing, or damaged beyond normal wear while in the Customer's possession, to the extent permitted by law.
The Customer agrees to provide safe and reasonable access for delivery and pickup. For standard exterior placement, paths must be reasonably clear and all animals securely contained away from the service area. If the Customer specifically authorized garage or backyard/gated-area access, that authorized area must be unlocked and safely accessible during the service window. Shenandoah Stuff Gone will not enter interior living areas of the residence and may postpone, relocate, or refuse service where conditions reasonably appear unsafe or where required access authorization has not been provided.
If totes are not ready or accessible during the confirmed pickup window, a $25 return-trip fee may apply. Prohibited, unsafe, contaminated, or overweight items that require special handling may result in a $25 handling fee per affected tote or bag, plus applicable third-party disposal charges, when disclosed and permitted by law.
The Customer authorizes Shenandoah Stuff Gone to photograph the totes, their placement, condition, accessibility, and visible contents when reasonably necessary at delivery and pickup for operational, safety, damage, dispute, and service-documentation purposes. This provision does not automatically grant permission to use identifiable photos of the Customer, household members, home address, or private property for advertising.
The Customer is responsible for selecting and maintaining a reasonably suitable location for totes after delivery. Customers should consider grass, landscaping, irrigation systems, soft ground, driveways, walkways, and other surfaces when selecting a location and should promptly relocate a tote when its continued placement could reasonably damage property or create a hazard. Any limitation or allocation of liability for property damage applies only to the extent permitted by Virginia law.
The Customer is responsible for accurately identifying and properly handling the items placed in the totes. If undisclosed prohibited materials cause contamination, cleanup costs, disposal charges, penalties, damage, or other expenses, the Customer may be responsible for those costs to the extent permitted by law.
Shenandoah Stuff Gone reserves the right to refuse, suspend, or discontinue a pickup when reasonably necessary because of overweight totes, hazardous or prohibited contents, aggressive animals, unsafe property conditions, blocked access, suspected illegal materials, threatening or abusive conduct, unsafe weather, or other circumstances that make service unsafe or unlawful. Refusal to transport a prohibited or unsafe item does not require the Company to take possession of that item.
The Customer agrees to the price displayed and accepted at booking. Additional charges may apply for approved services outside the original booking, including additional totes, contractor bags, extended service periods, failed pickups, additional trips, special handling, or special disposal arrangements. Material additional charges will be disclosed through the booking terms or separately authorized by the Customer as applicable.
Shenandoah Stuff Gone provides a decluttering tote and removal service and does not guarantee that use of the service will completely organize, clean, or declutter a Customer's home. The Company does not provide legal, tax, environmental, appraisal, or valuation advice regarding Customer property.
The Customer acknowledges the ordinary responsibilities associated with possessing and filling totes, including maintaining their location, preventing unauthorized use, avoiding overloading, preventing prohibited materials from being deposited, and maintaining reasonable access. The Customer agrees to exercise reasonable care while using the service. Nothing in this Agreement releases Shenandoah Stuff Gone from liability that cannot lawfully be released or limited under applicable law.
To the extent permitted by applicable Virginia law, the Customer agrees to be responsible for claims, losses, liabilities, costs, or expenses arising from the Customer's breach of this Agreement, unauthorized relinquishment of another person's property, placement of prohibited or unlawful materials, unlawful conduct, or misuse of the totes. This provision is not intended to require the Customer to indemnify Shenandoah Stuff Gone for liability that cannot lawfully be shifted or limited.
Nothing contained in these Terms is intended to waive, disclaim, restrict, or eliminate any right or liability that cannot legally be waived, disclaimed, restricted, or eliminated under applicable law. If a provision is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, to the extent applicable.
The Customer agrees that the booking process may be completed electronically and that the Customer's electronic acceptance may constitute their agreement to these Terms to the extent permitted by applicable law. The Customer has the opportunity to review these Terms before accepting them and should retain the booking confirmation for their records.
